Welcome to OrchardTech. The terms "we," "us," and "our" refer to OrchardTech. OrchardTech operates this website and related services, including all information, content, features, tools, products, and services offered herein (the "Services"). OrchardTech is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), govern your access to and use of the Services.   1. Warranty and Support: All warranty claims, support inquiries, and product complaints must be directed solely to OrchardTech. You acknowledge that the original manufacturer or its official distributors may not honor warranties or provide support for products purchased through OrchardTech.

  2. Product Representation: We make every effort to display the colors, packaging, and features of our products accurately. However, the actual appearance may vary based on your device’s display settings. All images are for illustrative purposes only and may differ from the actual product received.

  3. Product Variations: Product descriptions, specifications, and availability are subject to change at any time without notice. We reserve the right to discontinue any product or limit quantities available to any person or region.

SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. OrchardTech reserves the right to accept or decline your order for any reason at its sole discretion. Your order is not accepted until you receive an order confirmation email from us.

Please review your order carefully before submission. We may not be able to accommodate cancellation requests after an order has been accepted. If we do not accept, change, or cancel an order, we will attempt to notify you using the contact information provided.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy [LINK]. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

We are not liable for shipping and delivery delays caused by shipping carriers, customs processing, or events outside our control. All delivery times are estimates only and are not guaranteed. Once we transfer products to the carrier, title and risk of loss pass to you.

OrchardTech is powered by Shopify, which enables us to provide the Services. However, any sales and purchases you make are made directly with OrchardTech. You acknowledge that Shopify is not responsible for any aspect of any sales between you and OrchardTech. You hereby expressly release Shopify and its affiliates from all claims arising from or related to your purchases and transactions with OrchardTech.

THIS INCLUDES, BUT IS NOT LIMITED TO, ANY CLAIMS AGAINST THE ORIGINAL MANUFACTURER OR OFFICIAL SUPPLIER. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM.

SECTION 18 - INDEMNIFICATION
You agree to indemnify and hold harmless OrchardTech and its affiliates from any claims, damages, or expenses arising out of your breach of these Terms or your violation of any law or third-party rights.

SECTION 19 - SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

SECTION 20 - WAIVER; ENTIRE AGREEMENT
The failure of us to exercise any right shall not constitute a waiver. These Terms constitute the entire agreement between you and us and supersede any prior agreements.
